This website, happyjoevents.com (the “Site”), is owned and operated by HappyJo Events, a business operating under the laws of Québec, Canada. In these Terms of Use (“Terms”), “we,” “us,” and “our” refer to HappyJo Events, and “you” or “your” refers to any individual user of our Site. Please read these Terms carefully. By using our Site, you accept and agree to be bound by and comply with them, and with our Privacy Policy. If you do not agree, you must not use our Site.

Use of our site and services

When you access our Site or opt in to any of our services, you are given reasonable notice that these Terms exist. By using our Site, you agree to be legally bound by these Terms and our Privacy Policy, whether or not you have read them.

By purchasing or accessing any of our services, you confirm that you are at least 13 years of age. If you are using this Site on behalf of an employer, you confirm you have the authority to bind your employer to these Terms.

While we work to keep our Site accurate and current, we cannot guarantee that all content is complete or up to date. We reserve the right at any time to modify or discontinue, in whole or in part, any service offered, or to change prices without notice.

Fees and refunds

Fees are listed on our Site and in Canadian dollars. We reserve the right to change fees at any time and without notice.

Bookings of planning packages are subject to the terms set out in your signed service agreement, including any deposit, payment schedule, and cancellation or refund policy specific to that engagement. Where a fee is recurring or paid by instalments, you authorize continued access to your payment information until the balance is paid in full.

Intellectual property

All content, materials, images, text, designs, graphics, page layouts, icons, videos, logos, taglines, trademarks (whether common law or registered), and copyright on our Site or social media is owned by HappyJo Events unless otherwise attributed.

You may not copy, republish, distribute, modify, or otherwise use any of our intellectual property without our written permission. You may share short excerpts of our content on personal social media for non-commercial purposes, provided you credit HappyJo Events and link back to the original source.

Security

We make commercially reasonable efforts to protect your information, but the transmission of information via the internet is not completely secure. You acknowledge that any transmission of personal data to our Site is at your own risk, and we cannot guarantee the security of information transmitted to us.

Where our Site connects with third-party applications such as scheduling, payment, or email services, you understand that those services operate under their own terms and security practices.

Assumption of risk and disclaimers

Use of this Site is at your own risk. You agree that the Site, its contents, and any services found or accessed through it are provided on an “as is” and “as available” basis, without warranty of any kind, express or implied.

Any testimonials, results, or outcomes referenced on this Site are illustrative only. Every wedding and client experience is unique; we make no guarantee that you will experience the same results.

Limitation of liability and indemnity

To the maximum extent permitted by law, HappyJo Events and its team will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services.

Our maximum liability for any cause, regardless of the form of action, will be limited to the actual amount you paid us for services in the twelve months preceding the claim.

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, costs, or expenses arising out of your misuse of the Site or breach of these Terms.

Disputes and claims

If you have a dispute or claim relating to the Site or our services, please first contact us in writing at joanne@happyjoevents.com so we can attempt to resolve it informally.

We will respond to your notice within ninety (90) days. Any unresolved disputes will be governed by the laws of Québec, Canada, and resolved in the courts of that province.

General

These Terms, together with our Privacy Policy, form the full agreement between you and HappyJo Events relating to your use of the Site and services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

We may update these Terms from time to time. The most current version will always be posted on this page with the date of the most recent update noted at the top.
